Standard terms of delivery

 
1. Delivery
Domenia Norge AS delivers and maintains web pages, domain names and search words. Domenia Norge AS also provides server services and other net-based services to customers according to the agreement with the customer. Domenia Norge AS is responsible to make sure the services are delivered in accordance with the order, unless something else is said in the deal or in the terms listed below.
The costs of registering and yearly charges cover changes to former registrations, maintaining of the name and a quality check of registered data.

2. Ordering
All orders should be made in writing, to make sure the

customer gets the right delivery. Domenia Norge AS receives orders by fax, e-mails or registered letters. Oral agreements are binding for Domenia Norge AS when the company has confirmed in writing.

3. Terms of payment
(All prices excludes VAT).

The customer has 14 days credit time running from the invoice date. After this date the interest rates are calculated after the law of interest on overdue payments (9 %, autumn 2005), but still it will be interest free from the first year if the collection takes more than six months. In cases of debt collection, the rules in the debt law will be followed. All payments from the customer to Domenia Norge AS covers the oldest of the invoice claims, even if the customer has said something else.

4. Cost changes
Our customers will automatically have the benefit in cases of price reductions. Domenia Norge AS reserves the right to change prices for registration and maintenance of domain names caused by the registration governs’ increasing charges. In other cases the prices will follow the index-linked with yearly adjustments. For general changes of price, Domenia Norge AS may increase the prices to the level for new contracts with six months warning.

5. Time limit for complaint
If the customer believes that a product or a service delivered by Domenia Norge AS does not fulfil the terms of condition, the customer must inform Domenia Norge AS about this in writing within 14 days after the product/service has been delivered in cases where the mistake is found at once. For deficiencies occurring later than this, the time limit is set from the mistake or deficiency occurred. If the customer can make probable that the deficiency was discovered at a later time, the time limit of complaint is valid from the time the deficiency was discovered.

6. Information from the customer
To provide the service the maintenance charge covers, Domenia Norge AS is dependent that the customer continually provides Domenia Norge AS with information about the customer’s domain.

Domenia Norge AS can only be held responsible if the customer provable have given information that hasn’t been followed up.

7. The relation to registration authorities
Rules and conditions to register a domain name are drawn up by the different country’s registration authorities. The registration authorities have the right to accept, or refuse the registration of a domain name. The registration authorities can change rules for registration for a domain name and increase the prices without a preliminary warning.

The customer and Domenia Norge AS is obliged to follow the rules and prices that is valid at any time.

The conditions of the contract for the different top domains (TId) can be found on the registration authorities’ webpage.

Domenia Norge AS takes the full responsibility for changes or curtails in the users rights, following changes in the official rules in Norway or another country, or in organisations that decides the rules for the use of domains and web pages.

8. Change of address
The customer should continually inform Domenia Norge AS about their contact details, like address, phone number, fax, mobile phone number and e-mail address.

9. Automatic renewal
All subscriptions are automatically renewed for a new length of time, the same as the contract is signed for, from the expiring date of the time of period. The automatic renewal is stopped by a written warning from the customer at lest 30 days before the subscription is renewed.

10. Correcting mistakes
Domenia Norge AS will correct all mistakes Domenia Norge AS is responsible for, as soon as it is practically possible. Domenia Norge AS will also contribute to correct mistakes we are not responsible for within a reasonable time. If the mistakes are caused by something the customer is responsible for, for example by giving wrong information etc, Domenia Norge AS can demand a reasonable compensation for correcting the mistake.

11. Responsibility in cases of termination
In cases of termination Domenia Norge AS is obliged to adapt for an easy transfer of the customer’s right to a new ISP or registrar. If the customer has not given information on the transfer of rights, these rights will automatically be transferred to Domenia Norge AS. In this way Domenia Norge AS will be free of charge if the owner of a domain name that hasn’t been transferred within 14 days after the date of termination has run out, unless the customer can prove that this is caused by terms he/she is not in charge of.

When the date for termination has run out, Domenia Norge’s responsibility for the customer comes to an end.

If a termination occurs right before a renewal, it’s the date of renewal that is valid. This means that the responsibility from the renewal should have occurred, unless the customer has paid for a new period of time.

12. Responsibility in cases of default by the customer
If the customer defaults the duty to pay, Domenia Norge AS’s responsibility for the customer stops from the last day the customer has paid for.

13. Rules on responsibility in cases of default or termination
When the rights have been given to Domenia Norge AS, the company is free to maintain the domain, sell it or delete it. If the domain is sold within twelve months after the agreement is terminated, and this gives an exorbitant huge compensation, Domenia Norge AS should pay the customer the money that exceed the estimated cost of maintenance and administration, but this is limited up to 75 % of the compensation.

In cases when (1) more than 14 days have passed from the date of termination or (2) a new period of renewal has started that hasn’t been paid for, Domenia Norge AS’ responsibility is stopped.

If Domenia Norge AS has chosen to keep the domain name, the customer can get this back by paying all of Domenia Norge AS’ costs, as long as it hasn’t been made a new agreement with another potential buyer, or Domenia Norge AS has used the domain in another way. In these cases the customer may also get the domain back, as long as all involved parts are saved harmless.

14. Responsibility for mistakes by Domenia Norge AS
Domenia Norge AS takes the blame for all mistakes that are provable or without reasonable doubt is caused by gross negligence or on purpose by Domenia Norge AS.

The responsibility is limited to direct financial loss by the suffering customer, limited up to the customers’ total pay in the agreements time of period.

In other cases of defaults where Domenia Norge AS are held responsible, the customer will be credited for the reduction in value.

Domenia Norge AS is not responsible for defaults or mistakes caused by circumstances that Domenia Norge AS is not in charge of. This includes, but are not limited to, changes in sub-suppliers terms of conditions, internet collapses, or a default from one of Domenia Norge AS’ sub-suppliers etc (Force Majeure).
